Car Accidents and The MIST

Updated: Aug 23, 2021

The MIST, no, it's not a new horror movie but something just as scary. MIST stands for minor injury, soft tissue. This is what defense attorneys try to use against plaintiffs (injured patients) to try to diminish their injuries thus reducing the settlement. If you have read any of my previous blogs, you know that the amount of damage to the vehicle does not correlate with the amount of damage that can occur to the occupants of the vehicle. Vehicles are made to crush under impact to disperse energy. As a result the occupants take up less impact of the crash, but when there is low impact and little damage to the vehicle, the force travels through the vehicle and the occupants take the most impact. If there are underlying conditions to the occupants like, arthritis, disc degeneration, disc bulges, a small impact can cause major problems.

The way to properly dispute these claims by the defense is to have a great attorney that knows about soft tissue injuries and an attorney that works with a trauma trained physician that not only knows how to treat these injuries, but knows how to properly document and write a narrative that clearly correlates causality to bodily injury, and bodily injury to functional loss. If you have been injured in an accident, if you are a plaintiff attorney looking for a properly trained doctor, you need to contact the Auto Accident Pain Relief Center of Illinois 24/7 at 800-862-5914.
